These Terms and Conditions (“Terms”) govern access to, navigation of, and use of the website www.citystorage.mx (the “Site”), including all contents therein. The Site is made available by Operadora City Storage, S. de R.L. de C.V. (hereinafter, “City Storage”, “we” or “our”). For clarity, any reference within these Terms to “City Storage”, “we” and/or “our” also includes or may include its affiliates, subsidiaries, related entities and/or companies that are part of the same corporate group, which participate or may participate in making the Site available.
These Terms may be updated from time to time, without prior notice, and it will be sufficient for them to be published on the Site for them to become effective and binding.
Acceptance
Please carefully read these Terms, as they set forth the terms and conditions that will be legally binding on you as a user (“You”) of the Site. By accessing, browsing and/or using the Site, its contents or the services provided therein, including without limitation, interaction with the Site, submission of contact forms, questionnaires, comments, messages or opinions through the Site (hereinafter, the “Site Content”), You acknowledge that you accept and agree to these Terms in all their parts and undertake to comply with all the rules, terms, conditions, restrictions and notices included within the Terms.
If You do not agree with these Terms and/or do not expressly and unambiguously accept them, you may not make use of the Site or the Site Content, whether directly or indirectly. Likewise, you must refrain from using any type of data or information available through the Site or that, from time to time, City Storage may provide to you by any means.
Please note that the Site and the Site Content are only available to persons with full legal capacity and who may enter into legally binding contracts in accordance with Mexican law. If You are a minor or do not qualify under this condition, you are not authorized to use the Site or the Site Content, unless acceptance of these Terms is provided by your parents, guardians, conservators or legal representatives, who shall be legally responsible for any breach of the Terms and for any direct or indirect damage that may be caused to City Storage, or that You as a minor or legally incapacitated person may suffer.
These Terms apply regardless of the type of device used to access the Site (for example, mobile devices, computers or any other technology compatible with it).
Site contents
The Site Content includes or may include information, features, and services related to the contracting, administration, use, and operation of storage units for individual or household storage. This may include, among others, descriptions of the services offered, specifications of the storage units, rates, promotions, tools to manage reservations, access to user accounts, informational materials, FAQs, contact forms, advertising materials, as well as redirects to third-party sites or platforms necessary for or related to the provision of individual or household storage unit services.
The Site Content listed and described above may be modified, limited, or added from time to time at the sole discretion of City Storage, in which case, it shall be understood that these Terms will cover the Site Content actually available on the Site and/or used by You.
Service contracting
Through the Site, You may request information, contact us, or begin the process of renting a storage unit. However, the lease or provision of services related to storage units for individual or household storage will only be finalized through the execution of a separate agreement between You and City Storage. Such agreement shall definitively govern the rights and obligations of both parties with respect to the lease of storage units and shall be interpreted independently of these Terms.
Site usage
4.1 Permitted use: Your use of the Site, as well as the Site Content, must be in good faith, in a diligent and appropriate manner, and always in accordance with these Terms, the applicable laws and regulations. City Storage grants You a non-exclusive, non-transferable and revocable authorization to access and use the Site and the Site Content, solely for personal and non-commercial purposes.
4.2 Prohibited conduct: By accessing, browsing or using the Site and accepting these Terms, You agree and undertake not to do the following:
Use the Site or the Site Content in an illegal, fraudulent or malicious manner.
Interfere with or disrupt the integrity or performance of the Site.
Attempt to obtain unauthorized access to the Site or any related system or network.
Copy, modify, distribute, reverse engineer or create derivative works based on the Site or the Site Content.
Use the Site or the Site Content in a manner that infringes the rights of City Storage or third parties, including, without limitation, intellectual property rights.
Use the Site to transmit any virus, worms or other harmful computer code.
Engage in any activity that may damage, disable or impair the Site or the Site Content.
Use the Site or the Site Content in a harmful or offensive manner to City Storage or any natural or legal person.
Extract all or part of the Site Content for purposes of defamation, misrepresentation, alteration, confusion or distortion.
Violate any applicable law or regulation in Mexico or abroad.
Privacy and personal information
5.1 Privacy Notice: When, as a result of using the Site, or for the purpose of communicating with us, You share personal information (or personal data) with us, the processing of such personal data will be subject to our Privacy Notice available at citystorage.mx/avisodeprivacidad, which explains how we collect, store, use, disclose, and process information about You.
5.2 Personal Information: We collect and process personal data as described in our Privacy Notice. You are responsible for ensuring the accuracy and legality of any personal data you provide to us.
5.3 Third-Party Information: 1.1 When, as a result of using the Site, You provide us with third-party information, You declare, warrant, and agree that You have the right to do so freely, that such information does not infringe intellectual property rights or any other third-party rights, and that such information is neither confidential nor harmful to third parties. You also agree to hold City Storage harmless from any claim that may arise from the fact that You have shared such third-party information with City Storage.
Intellectual property
6.1 Ownership: You acknowledge and agree that City Storage is and shall remain the sole and exclusive owner of all rights, title, and interest in and to the Site, the Site Content, its code, information, data and materials, its look and feel, arrangement, compilation, design and organization, including all copyrights, trademarks, inventions, image-use authorizations, and any other intellectual property rights and proprietary rights therein. Any audio, video, photograph, illustration, graphic or visual element, typefaces, bullets, pop-up windows or pop-ups, among others, that are visible anywhere on the Site are and shall continue to be the exclusive property of City Storage.
Your use of the Site or the Site Content does not grant you ownership of or any license to them, and therefore any reproduction, distribution, publication, or commercial exploitation of the Site or the Site Content is prohibited, unless prior written authorization is obtained from City Storage and/or the relevant rights holders, as applicable.
Use of the Site or the Site Content, in violation of or beyond what is provided for in these Terms, may constitute an infringement of copyrights, industrial property rights, and other rights protected by Mexican laws, in which City Storage or other third parties are direct or indirect owners or co-owners. City Storage and any licensee or third party authorized by it reserve the right to bring all legal actions and seek all injunctive relief that may be applicable under the applicable law.
6.2 Trademarks: The trademarks, designs, trade names, commercial notices, and any other distinctive sign or copyrighted work (the “Distinctive Signs”) displayed on the Site or contained in the Site Content are owned by City Storage or other related third parties and may not be used in connection with products and/or services that are not associated with, related to, sponsored by, or distributed by their respective rights holders. Therefore, you acknowledge and agree to respect the Distinctive Signs, not copy, distort, or mutilate them, not use them or attempt to use them for your own purposes, and not attempt to register them in your own name or in the name of third parties, whether before Mexican authorities or abroad. The restrictions set forth in this provision for the Distinctive Signs shall apply equally to any Distinctive Sign that is confusingly similar or that, for any reason, may cause consumer confusion by encouraging or allowing the products or services offered under such Distinctive Signs to be associated with those owned by City Storage.
All Distinctive Signs that are not owned by City Storage and that appear on the Site, if any, are the property of their respective owners, and you agree not to use them or attempt to register them, in Mexico or abroad.
Nothing contained in the Site, the Site Content, or these Terms may or should be interpreted, implicitly or explicitly, as granting a license or right to use the Distinctive Signs displayed on the Site, without the prior written permission of their respective owners.
Failure to comply with these provisions in relation to the Distinctive Signs may result in the initiation of administrative or judicial proceedings for infringement of intellectual property rights protected by Mexican laws.
6.3 Authorization: Subject to compliance with these Terms and subject to the strict limitations set forth herein, you are granted a limited, non-exclusive, and non-transferable authorization to use the Site and the Site Content, solely for personal purposes, provided that these are non-profit. You expressly agree not to alter, modify, or remove any copyright notices or notices of protected rights contained in the Site or the Site Content.
6.4 Restrictions: The authorization referred to in the preceding section and any other authorization granted under these Terms does not authorize you to modify, copy, reproduce, publicly communicate, transform, or distribute, by any means and in any form, all or any part of the Site or the Site Content.
Suspension and cancellation
7.1 Suspension and cancellation of the site: City Storage reserves the right to suspend, modify, restrict, or interrupt, whether temporarily or permanently, access, hosting, download and/or use of the Site or the Site Content, with or without prior notice, if You violate any of the provisions detailed in these Terms, or the provisions established in applicable law, without You being entitled to claim any compensation for this reason. We may also suspend, restrict, or cancel the Site if there are elements that reasonably allow us to infer that your use of the Site is contrary to applicable law or these Terms.
Linked sites
The Site may make technical linking devices available to you (such as, among others, links, banners, buttons, stickers, GIFS), directories and tools that allow you to access various services, content and/or information, which may be found on websites managed by third parties (hereinafter, “Linked Sites”). City Storage does not offer or market, either itself or through third parties, the products and/or services available on the Linked Sites. Therefore, You must exercise utmost caution when assessing and using the services, information, data, files, products and any kind of material existing on the Linked Sites.
City Storage does not guarantee or assume responsibility for damages of any kind that may arise from: (a) the operation, availability, accessibility or continuity of the Linked Sites; (b) the maintenance of the services, content, information, data, files, products and any kind of material existing on the Linked Sites; (c) the provision or transmission of the services, content, information, data, files, products and any kind of material existing on the Linked Sites; and (d) the quality, lawfulness, reliability and usefulness of the services, content, information, data, files, products and any kind of material existing on the Linked Sites.
Limitation of liability

City Storage does not guarantee or assume responsibility for damages of any kind that may arise from: (a) the operation, availability, accessibility or continuity of the Linked Sites; (b) the maintenance of the services, content, information, data, files, products and any kind of material existing on the Linked Sites; (c) the provision or transmission of the services, content, information, data, files, products and any kind of material existing on the Linked Sites; and (d) the quality, lawfulness, reliability and usefulness of the services, content, information, data, files, products and any kind of material existing on the Linked Sites.
Limitation of liability
City Storage does not guarantee the availability and continuity of the Site's operation. When reasonably possible, You will be notified of current or future interruptions of the Site.
To the maximum extent permitted by applicable law, in no event shall City Storage be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, whether in an action based on contract, tort (including negligence) or otherwise, arising from the use, unavailability, or inability to use the Site, even if You have been advised of the possibility of such damages.
We do not control or guarantee the absence of viruses or other elements on the Site that may cause alterations to your computer system (software or hardware), electronic documents and/or files stored on your computer system, and therefore we cannot assume responsibility for damages and losses of any kind that may result from such alterations.
City Storage shall not incur any liability for charges for Internet access, or the use and transmission of data, necessary to make use of the Site, and therefore any charges that You may incur for their use, which may be charged by your telephone operator or by your Internet or network access provider, shall be borne by You and payable solely by You.
You agree to indemnify, defend and hold harmless City Storage from any claim, loss, damage, liability and expense (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, the violation of any applicable law or regulation, or the improper use of the Site or the Site Content.
Disclaimer of warranties
The Site and the Site Content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.
Applicable law and dispute resolution
By accessing, browsing, or using the Site, You agree to comply with any applicable legal provision in Mexico, regardless of the country in which You are located or of which You are a resident.
The use of the Site and these Terms are subject to the laws applicable in Mexico, and the competent courts of Mexico City, Mexico, shall have jurisdiction for the resolution of any dispute arising therefrom.
Modifications
City Storage reserves the right to modify these Terms, in whole or in part, by publishing any change in the same manner in which these Terms appear or through another means of communication addressed to you as a user of the Site. Accessing, browsing, and/or using the Site after such modifications or changes take effect implies acceptance of the Terms.
Electronic communications
When you communicate with us electronically (e.g., by email, text message, or contact forms), you agree to receive electronic communications from us, including all statements, notices, and disclosures, and you agree that the communications we provide to you electronically satisfy any applicable legal requirement or formality for written notices.
Miscellaneous provisions
14.1 Waiver: The fact that we do not exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14.2 Headings: The headings included in these Terms are for drafting and clarity purposes only, and in no case shall they have any effect on the validity, interpretation, and/or conditions established herein.
14.3 Severability: If any provision of these Terms is deemed invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remaining provisions shall not be affected or impaired in any way.
14.4 Entire Agreement: These Terms, together with the Privacy Notice, constitute the entire agreement between City Storage and You with respect to the Site and the Site Content, and supersede any prior understanding or agreement, whether written or oral.
